Privacy Policy and Terms of Use

This Privacy Policy and Terms of Use (hereinafter – the Terms) establish the rules for the use of http://happypaw.ua  website (hereinafter – the Website) by visitors and users of the Internet (hereinafter – the Internet User), including:

  1. Terms of using the Website materials;
  2. Terms of placing materials on the Website by the Internet Users;
  3. Terms of personal data use;
  4. How to submit data deletion request;
  5. Rules for transferring donations.

Happy Paw Charity Foundation is the owner of the Website (hereinafter – Happy Paw). The Website is an online representation of Happy Paw and is an electronic platform for posting information related to Happy Paw’s activities as well as activities of third parties.

The use of the Website by the Internet User means that the latter accepts and undertakes to comply with all provisions of these Terms.

These Terms may be amended in whole or in part by Happy Paw at any time without any special notice thereof. The new version of the Terms enters into force from the moment of its publication on the Website.

1. Terms of Using the Website Materials

1.1. The Website contains objects of intellectual property (including objects of copyright, trademarks) and other materials protected by law: photos, video materials, graphic images, music, sound works, etc.

Happy Paw has the exclusive right to use the content of the Website (including the right to select, arrange, systematize and transform the data contained on the Website, as well as the original data itself), except for the cases separately specified in the content of the materials published on the Website.

1.2. The Internet User can upload (download) from the Website materials, the rights to which belong to Happy Paw, for personal use only.

Distribution, publication or other use of Website materials is not allowed without reference to the copyright holder (without reference to the Website).

1.3. In case of violation of para. 1.2 hereof, the Internet User bears the responsibility provided for by the applicable Ukrainian law.

2. Terms of Placing Materials on the Website by the Internet Users

2.1. The Internet User undertakes to use the Website for legal purposes only. The Internet User undertakes not to post materials of the following nature on the Website:

- violating the law of Ukraine;

- containing threats and insults, violating public order, being obscene;

- in one way or another violating the honor and dignity, rights and interests of other persons protected by law;

- contributing to or containing calls to incite religious, racial or ethnic enmity, containing attempts to incite enmity or calls for violence, as well as other materials that in any way violate the law of Ukraine.

Happy Paw is not responsible for the personal opinion posted by the Internet User on the Website.

2.2. The Internet User undertakes not to use the Website for advertising or other sales promotion of any goods and services.

2.3. The Internet User undertakes not to download and/or place on the Website any materials whose intellectual property is protected by law (including copyright, trademark law), and other materials protected by law, without obtaining written permission from the copyright holder of the protected material. Furthermore, the Internet User is liable for proving that the placement of materials on the Website does not violate the copyright, related rights and other rights of third parties to the posted materials.

2.4. When placing any materials on the Website for public use, the Internet User thereby automatically provides Happy Paw (or acknowledges that the owner of such materials has provided Happy Paw) with the right to use such materials.

The Internet User also provides access, allows viewing, storage or reproduction of such materials to other users of the Internet for personal use.

2.5. Happy Paw has the right to use the data from the social accounts of the Internet User (Facebook, Twitter, Vkontakte, etc.) for personal purposes in the event of using the materials of the Website, as well as posting information on the Website using such accounts.

2.6. The Internet User agrees that he is solely and fully responsible for placing materials on the Website, including for the content of such materials, their compliance with the requirements of the law, for violation of the rights of third parties to the materials posted by the Internet User. The Internet User undertakes to compensate for any damages arising from such violations, as well as any damages arising from downloading such materials.

2.7. Happy Paw has the right to delete the information posted on the Website that violates paragraphs 2.1-2.4 hereof.

3. Terms of Personal Data Use

3.1. By providing his personal data, the Internet User provides Happy Paw with his consent and permission to process such personal data.

3.2. In the event the Internet User provides Happy Paw with his personal data (full name, date of birth, residential address, phone number, contact e- mail , etc. ), Happy Paw guarantees that such personal data will not be transferred to any third parties, except for the cases stipulated by the law of Ukraine.

3.3. Happy Paw is the owner of personal data within the meaning of para. 3 Art. 2 of the Law of Ukraine “On Personal Data Protection”.

3.4. The Internet User, who provided his personal data, is the subject of personal data within the meaning of para. 12 Art. 2 of the Law of Ukraine “On Personal Data Protection” and has the right to:

3.4.1. know the location of the personal data base where his personal data is stored, its purpose and name, location and/or place of residence of its owner or manager of personal data, or give the appropriate order to receive this information by persons authorized by him, except for cases established by law;

3.4.2. receive information about the conditions for providing access to personal data, in particular, information about third parties to whom personal data is provided;

3.4.3. access to his personal data;

3.4.4. receive no later than 30 calendar days from the date of receipt of the request, except in cases provided by law, an answer on whether his personal data is stored in the relevant personal data base, as well as to receive the content of his personal data that is stored;

3.4.5. make a reasoned request for the change or destruction of his personal data by any owner and manager of the data if such data are processed illegally or are unreliable;

3.4.6. make a reasoned request to the owner of personal data with an objection to the processing of his personal data;

3.4.7. protect his personal data from illegal processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision of data, as well as protection from providing inaccurate information or information that depresses the honor, dignity and business reputation of a person;

3.4.8. file complaints about the processing of his personal data to the public authorities and officials authorized to ensure the protection of personal data, or to the court;

3.4.9. apply legal remedies in case of violation of the law on personal data protection;

3.4.10. include a clause limiting the rights to process his personal data when giving consent;

3.4.11. withdraw his consent to the personal data processing;

3.4.12. know the mechanism of the personal data automatic processing;

3.4.13. protect against an automated decision that has legal consequences for him.

3.5. The purpose of collecting personal data is to support further communication with the Internet Users.

3.6. The User may exercise the rights defined in subparagraphs 3.4.1., 3.4.2., 3.4.3., 3.4.4., 3.4.5., 3.4.6., 3.4.11 by sending a request, letter, warning or other message in any form to the email address hello@happypaw.ua. Please note that anonymous letters, requests and other appeals are not considered. In order to avoid cases with fraud, Happy Paw has the right to demand from the Internet User documents (scanned copies of such documents) confirming his identity.

4. How to Submit Data Deletion Request

4.1 Automatic Removal via Facebook

You can remove your data by removing our app from your Facebook settings:

  • Go to Facebook Settings
  • Click on Apps and Websites
  • Locate our app and click Remove
  • Check the box to delete all data and confirm

4.2 Manual Deletion Request

If you would like to delete your data collected by our app, please contact us at:

Please include the following details in your request:

  • your full name;
  • the email address used on the Website;
  • a clear statement that you wish to delete your data.

Once we receive your request, we will delete your data from our servers and confirm the deletion.

5. Rules for Transferring Donations

The rules for transferring funds are mandatory for all users of the happypaw.ua website.

The benefactor who transfers charitable assistance chooses the amount of the donation and the possibility of making a regular payment at his own discretion.

The benefactor agrees that the transferred charitable contribution is voluntary and may be returned provided that the benefactor applies with a corresponding request to Happy Paw via email hello@happypaw.ua within 14 calendar days from the moment the donation is sent and provided that it is not used for its intended purpose at the time of the request.

The benefactor agrees that depending on the section of the Website, the benefactor can choose the intended purpose of his donation:

1. For the statutory activities of the Foundation via https://happypaw.ua/ua/contribution or via a pop-up button (a pop-up window about help on the Website);

2. For the One-Time Help Project via https://happypaw.ua/ua/once , where you can choose a specific one-time action;

3. For the Help to Seriously Ill Animals Project via https://happypaw.ua/ua/assistance , where you can choose a specific animal;

4. For the Remote Guardianship Project via https://happypaw.ua/ua/guardianship , where you can apply for guardianship of a specific animal and donate a fixed amount monthly for the maintenance of the animal in the shelter.

5. For the Shelter Guardianship Project via https://happypaw.ua/ua/hosts , where you can apply for guardianship of a specific shelter and donate monthly for the maintenance of animals in this shelter.

The purpose of donations for the Foundation’s statutory activities is determined independently and directed by Happy Paw to the implementation of any projects or to finance administrative expenses within the framework of its statutory activities and within the framework of the applicable laws of Ukraine.

The transferred donations to such projects as: One-Time Help, Help to Seriously Ill Animals, Remote Guardianship, Shelter Guardianship are used by Happy Paw for their intended purpose according to the description of each project and each specific action or animal story.

The benefactor agrees that if the actual amount of expenses from a separate action or animal is less than the amount of collected donations, the unused balance of the funds is credited to the statutory activities of the Foundation, where it can be directed either to any other action (or animal) within the framework of this project, or to other projects of the Foundation within the framework of statutory activities, or to finance administrative expenses in accordance with the applicable law of Ukraine.
